Terms and Conditions

1. About EduLift

EduLift Academic Tutoring (“EduLift”, “we”, “our”, “us”) is a tutoring service based in Piara Waters, Perth, Western Australia. We provide academic tutoring services for students from Year 1 through to Year 12, including ATAR, GATE/ASET preparation, and NAPLAN preparation, aligned with the Western Australian SCSA curriculum.

2. Acceptance of Terms

By accessing our website, enrolling in our tutoring programs, or using any of our services, you (“the parent”, “guardian”, “student”, “you”) agree to be bound by these Terms and Conditions. These terms apply to all tutoring services (group and individual), delivered in-person or online. If the student is under 18 years of age, a parent or legal guardian must accept these terms on their behalf. If you do not agree, please do not use our services.

3. Enrolment and Registration

  • Enrolment is subject to availability and confirmation by EduLift.
  • Parents or legal guardians must complete the enrolment process for students under 18 years of age.
  • You agree to provide accurate, current, and complete information during registration.
  • Families enrolling mid-term will be offered a pro-rata fee based on the number of sessions remaining in the term.
  • EduLift reserves the right to refuse or cancel enrolment at our discretion.

4. Tutoring Services

  • Small Group Sessions: $50 per hour.
  • Individual / Exam Intensive Sessions: $80 per hour.
  • Pricing may be updated from time to time. Any changes will be communicated prior to the next term.
  • Session times, formats (online or in-person), and locations will be communicated upon enrolment.
  • EduLift reserves the right to modify session schedules, tutors, or formats with reasonable notice.
  • We follow the Western Australian school term calendar. Term dates and session schedules will be communicated in advance.
  • While we support students in achieving their best, we do not guarantee specific academic results, as outcomes depend on multiple factors including individual effort, attendance, and engagement.

5. Payment Terms

Group Class Fees

  • Group classes are billed per term.
  • Payment may be made upfront via bank transfer or Stripe, or through a fortnightly or monthly payment plan as agreed upon at enrolment.
  • Parents using a payment plan must provide at least 14 days’ written notice to cancel or pause future payments.

Individual Session Fees

  • Individual sessions may be paid weekly or upfront for a block of sessions (e.g., 4 or 8 weeks), as agreed during enrolment.
  • Payment methods include bank transfer or Stripe.

General

  • All fees are payable in Australian Dollars (AUD) and are inclusive of GST where applicable.
  • Payment is required prior to the commencement of sessions unless alternative arrangements have been agreed upon in writing.
  • Non-payment or late payment may result in temporary suspension of tutoring services until the account is brought up to date.

6. Cancellation, Missed Classes and Make-Up Policy

Group Sessions

  • Please provide at least 24 hours’ notice if your child will miss a group class.
  • Group sessions cannot be rescheduled for individual students. However, we will do our best to offer an alternative group session during the same term, subject to availability.
  • If an alternative session is not possible, up to two (2) missed group classes per term (with prior notice) may be credited towards the following term.
  • Missed group classes without notice, or declined alternative sessions, will not be refunded or credited.

Individual Sessions

  • A minimum of 24 hours’ notice is required to cancel or reschedule an individual session.
  • Cancellations with less than 24 hours’ notice will be charged the full session fee.
  • If EduLift cancels a session, a make-up session or full credit for the cancelled session will be provided.

No-Shows

  • If a student does not attend a scheduled session (group or individual) without prior notice, the full session fee will be charged and no credit or refund will be provided.

7. Refunds

  • All payments are non-refundable, except where required under Australian Consumer Law.
  • Refunds are not issued for change of mind, missed classes, or early withdrawal without adequate notice.
  • If you wish to withdraw from a term program, written notice must be provided at least 7 days before the next billing cycle. Remaining session credits will be assessed on a case-by-case basis.
  • If EduLift cancels a session (e.g., due to tutor illness or unforeseen circumstances), we will reschedule or offer a credit towards future sessions.

8. Sibling Discounts

  • EduLift offers discounts for families enrolling multiple children in group classes.
  • Discount details will be communicated at the time of enrolment.
  • Sibling discounts apply to group class fees only and cannot be combined with other promotional offers unless specified.

9. Referral Program

  • If you refer a new family who enrols for a full term, both you and the referred family may be eligible for a discount on that term’s fees.
  • Referral discount details will be communicated on our website or upon enquiry.
  • Both families must notify EduLift to activate the referral discount.
  • Referral credits apply to term payments only.

10. Student Behaviour and Code of Conduct

Students are expected to:

  • Attend all sessions regularly and punctually.
  • Be respectful towards tutors and fellow students.
  • Participate actively and complete any assigned work.
  • Use learning materials responsibly.

EduLift reserves the right to discontinue services to any student whose behaviour is consistently disruptive, disrespectful, or unsafe, following parent/guardian consultation. No refund will be provided for remaining sessions in such cases.

Parents/guardians are expected to communicate respectfully with EduLift staff at all times.

11. Intellectual Property

  • All materials provided by EduLift, including worksheets, lesson plans, resources, and website content, are the intellectual property of EduLift Academic Tutoring and are protected by copyright.
  • Materials are provided for personal educational use only and must not be copied, reproduced, distributed, shared, or sold without written permission from EduLift.

12. Website Use

  • The content on www.edulift.com.au is provided for general information and educational purposes.
  • You may not use the website for any unlawful purpose or in any way that could damage, disable, or impair the site.
  • Free resources (worksheets, quizzes, diagnostic tools) are for personal use only and may not be redistributed.
  • We reserve the right to modify or discontinue any part of the website at any time without notice.

13. Privacy and Data Protection

  • EduLift is committed to protecting your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
  • Personal information collected (names, contact details, student details) will be used solely for the purpose of providing tutoring services, communicating with you, and administrative purposes.
  • We will not sell, share, or disclose your personal information to third parties unless required by law or with your consent.

14. Communication

  • We communicate with families primarily through email, phone, and messaging (e.g., SMS, WhatsApp).
  • Important updates regarding schedules, fees, or policies will be communicated via email to the address provided at enrolment.
  • It is your responsibility to ensure your contact details are kept up to date to avoid missing important updates.

15. Photography and Testimonials

  • EduLift may request permission to use photographs or testimonials for marketing purposes.
  • No images or testimonials will be used without prior written consent from parents/guardians.
  • Consent may be withdrawn at any time by notifying EduLift in writing.

16. Duty of Care and Safety

  • EduLift takes reasonable care to ensure the safety and wellbeing of students during tutoring sessions.
  • Parents/guardians must inform EduLift of any medical conditions, learning needs, allergies, or special requirements relevant to their child’s participation.
  • For in-person sessions, parents/guardians are responsible for the drop-off and pick-up of students. EduLift is not responsible for students outside of scheduled session times.

17. Limitation of Liability

  • EduLift provides tutoring services to support academic learning. We do not guarantee specific academic results, grades, or outcomes.
  • EduLift is not liable for any indirect, incidental, or consequential loss or damage arising from the use of our services or website.
  • Our total liability to you for any claim arising from our services is limited to the amount of fees you have paid for the specific session(s) giving rise to the claim.
  • EduLift complies with Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

18. Force Majeure

EduLift is not liable for any failure or delay in providing services due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, power outages, or internet failures. In such events, we will make reasonable efforts to reschedule sessions or provide alternative arrangements.

19. Suspension and Termination of Services

EduLift reserves the right to suspend or discontinue services in cases of:

  • Repeated non-payment of fees.
  • Ongoing behavioural concerns (following parent consultation).
  • Violation of these Terms and Conditions.

Written notice will be provided where practicable.

20. Dispute Resolution

  • Any disputes arising from these Terms and Conditions will be governed by the laws of Western Australia.
  • Both parties agree to attempt to resolve any dispute through good faith negotiation before pursuing formal legal action.
  • If a resolution cannot be reached, the matter may be referred to the appropriate dispute resolution body in Western Australia.

21. Changes to Terms and Conditions

  • EduLift reserves the right to update or modify these Terms and Conditions at any time.
  • Significant changes will be communicated via email or SMS.
  • Continued use of our services after changes are communicated constitutes acceptance of the updated terms.
